Product Order Terms and Conditions

 

General

The following are the terms and conditions ("Terms and Conditions") on which we supply any of the products ("Products") listed on our rackandtack.co.il website (the "Site") to you.

Please read these Terms and Conditions carefully before ordering any Product from our Site. By ordering Products from our Site, you agree to be bound by these Terms and Conditions and you will need to accept them, before completing your

order, by clicking on the button marked "I Accept" at the end of the order process. If you refuse to accept these Terms and Conditions, you will not be able to order any Product from our Site.


Placing an order

By placing an order through our Site, you agree that you are legally capable of entering into binding contracts and are at least 18 years old.

When placing an order for our Products, you will be required to provide your contact details.  You are required to provide true, accurate and complete details. If you provide us with false or incomplete details, we cannot guarantee that the

Products will reach their destination. If the products are returned due to false or incomplete contact details, you shall be charged with the handling and delivery fees.

After placing an order for our Products, you will receive an e-mail from us acknowledging that we have received your order. This does not mean that your order has been accepted by us but it does constitute an offer to us to buy the Product. All

orders are subject to acceptance by us, and we will confirm such acceptance to you by sending you an e-mail that confirms that the Product has been dispatched (the "Dispatch Confirmation"). The contract between us (the "Contract") will only

be formed when we send you the Dispatch Confirmation.

The Contract will only relate to those Products whose dispatch we have confirmed in the Dispatch Confirmation. If you have ordered additional Products that are not listed in the Dispatch Confirmation (for example because they are currently out

of stock / unavailable), these Products will not form part of the Contract until dispatch of such Products has been confirmed in a separate Dispatch Confirmation.

We reserve the right, at our sole discretion, to withhold or refuse an order for any reason. For example, we will not accept an order until receiving an approval from PayPal that it executed its transaction with you successfully.


Accuracy of information

We have made every effort to provide as accurate information as possible on the Site regarding our Products. However, actual Products may slightly differ from the information and illustrations we provide on the Site. Thus, the colors you see on

your monitor depend on the quality of your monitor and its settings. We cannot guarantee that your monitor’s display of any color will be accurate to the real color. Further, color, texture, and graining variations can occur in natural products like

leather, wood and stone. These are not normally considered imperfections. In addition, deviations in measurements, of up to 5%, in all Products, may occur.

 

Availability of products

If we have insufficient stock of a Product, you will be notified of this as soon as possible after your order has been received. You will be given the opportunity to wait until the Product is back in stock or cancel your order and secure a refund.


Price and payment

The price of our Products is the price in force on the date and at the time on which we process your order. We make every effort to ensure that the prices on our Site are accurate.

Nevertheless, it is always possible that, despite our best efforts, some of the Products listed on our Site may be incorrectly priced. We will normally verify prices as part of our dispatch procedures, so in the event that you order a Product at an

incorrect price we will cancel the order immediately and refund your payment. However we are under no obligation to provide the Product to you at an incorrect lower price quoted on our website, even after we have sent you a Dispatch

Confirmation, if the pricing error is obvious and unmistakable and could have reasonably been recognized by you as a mis-pricing.

All prices exclude VAT (which is shown to you at a later stage, but before completing your order) and delivery costs (which will be added to the total amount due as set out in our delivery).

Payment on the Site is conducted through PayPal. Your credit card details are held and secured by PayPal and are not disclosed to the owners of the Site.

For your attention, paying through PayPal is possible without prior registration.


Delivery

Your order will be fulfilled by the delivery date set out in the Dispatch Confirmation or, if no delivery date is specified, then within 30 business days of the date of the Dispatch Confirmation, unless there are exceptional circumstances.

Our delivery service can only deliver up to the 3rd floor without elevator; an additional fee will be applied for each additional flight of stairs climbed to make your delivery.

In case the Product cannot be delivered through the staircase, then it shall be supplied at the entrance of the building.

We shall not be responsible for delay in delivery due to forces beyond our control. 

We are not responsible for assembling and/or installing the Products.


Cancellation policy

Our cancellation policy for orders of products is subject to the Israeli Consumer Protection Law, 5741-1981 and the regulations made thereunder.

If you wish to return a Product, you may cancel the Contract, for any reason, within 14 days after receiving the Product. To cancel a Contract, you must inform us in writing at support@rackandtack.com  and return the item to the following address:

We will refund the price of the Product to you as soon as possible and in any case within 14 days of the day you have given notice of your cancellation. The price of the Product shall not be refunded in full, as the delivery charges for sending the

item to you are excluded from the refund. You will be responsible for returning the Product to us, in the same condition in which you received it, at your own cost and risk. You have a legal responsibility to take reasonable care of any Product

whilst they are in your possession. If you return a Product in a that was damaged whilst being under your care, including a product that was damaged, hit, broken, or that its package was damaged or that was assembled in a manner that

rendered it defective,  we may have a right of action against you for compensation.

In order to avoid damaging the Product, we recommend that you return the Product unused, in its original package.


Return policy for defective products

Our Products are checked and packaged carefully before being sent to you. However there may be the odd occasion when an item is below standard. In this case we ask you not to assemble or install the product, note the damage or deficiency

on the delivery documentation and email us immediately at support@rackandtack.com

If you received a defective product, you may cancel the Contract at any time within 14 days after receiving the defective Product. In such a case the price of the product shall be refunded in full.


Limited warranty

Rack&Tack Products are warranted against manufacturer's defects. The warranty is for a period of 1 year from the receipt date of the Product. The original purchase receipt is required as proof of purchase. The warranty does not cover

consequential or incidental damages. The warranty is to the benefit of the original purchaser of the Product, and it is not transferable.

The warranty does not apply to Products that have been stored or assembled incorrectly, used inappropriately, abused, misused, altered, or cleaned with wrong cleaning methods or wrong cleaning products. The warranty does not cover normal

wear and tear, cuts or scratches, or damage caused by impacts or accidents. The warranty does not apply if Products have been placed outdoors or in a humid environment or if the Products have been used for non-domestic purposes (unless

otherwise stated).

We will examine the Product and decide if it’s covered under this limited warranty. We will then, at our discretion, either repair the defective Product, replace it with the same or a comparable

Product, or provide a full or partial refund.


limitation of liability

All other express or implied terms, conditions, warranties or representations with regard to the Products, this Site or any information or service provided by us through this Site are excluded to the fullest extent permitted by law. Our liability for

losses you suffer as a result of buying our Products is strictly limited to the purchase price of the Product you ordered. We accept no liability for any failure to deliver, or for any delay in delivering, the Product, nor for any defect or damage to the

Product that is caused by circumstances beyond our reasonable control.


Import duty

If you order Products from our Site for delivery outside Israel, they may be subject to import duties and taxes which are levied when the delivery reaches the specified destination. You will be responsible for payment of any such import duties and

taxes and we have no control over these charges and cannot predict their amount. Please contact your local customs office for further information before placing your order.


Written communications

Applicable laws require that some of the information or communications we send to you should be in writing. When using our Site, you accept that communication with us will be mainly electronic. We will contact you by e-mail or provide you with

information by posting notices on our Site. For contractual purposes, you agree to this electronic means of communication and you acknowledge that all contracts, notices, information and other communications that we provide to you

electronically comply with any legal requirement that such communications be in writing.


Notices

All notices given by you to us must be given to Rack&Tack at support@rackandtack.com

We may give notice to you at either the e-mail or postal address you provide to us when placing an order. Notice will be deemed received and properly served immediately when posted on our Site, 24 hours after an e-mail is sent, or three days

after the date of posting of any letter.


Waiver and severability

If we fail to exercise any of the rights or remedies to which we are entitled, this shall not constitute a waiver of such rights or remedies.

If any of these Terms and Conditions or any provisions of a Contract are determined by any competent authority to be invalid, unlawful or unenforceable to any extent, such term, condition or provision will be interpreted as valid, lawful and

enforceable to the fullest extent possible, and severed from the remaining terms, conditions and provisions which will continue to be valid and unchanged.


Law and jurisdiction

Contracts for the purchase of Products through our site will be governed by Israeli law. Any dispute arising from, or related to, such Contracts shall be subject to the exclusive jurisdiction of the courts of Israel in the Tel Aviv or Central districts.
